This just in from one of our “whistleblowers” inside a Council in the East Of England.

For reasons of protecting the identity of our “source” we have removed any reference that could lead to him/her
I started working in the council tax department in 2007. After a training period of around 4 months i was considered trained to a sufficient standard, and was let loose.
I noticed immediately the attitude of 90% of my co-workers. It was very negative. Typically, they were very confrontational with the tax payers, the people we were employed to help (allegedly).
It quickly became quite clear that the behaviour of the council tax machine was infkuenced by one thing: collection rates.
Its worth noting that the target rate is around 99%. In fact, its probably worth noting a few things at this point:
- there are 8 bands of council tax, A-H, H being the highest
- A= £950 pa, B= £1120 pa, C= 1300 pa D= £1450 and so on
In the time that I’ve been there, i’ve learned a lot.
I’ve learned several ways that people shoot themselves in the foot, and i’ve learned the ways that people can avoid paying, and often get away with it.
- If you’ve applied for any type of housing or council tax benefit in the financial year, you have inadvertantly agreed to pay council tax. not nice, but now you know. Always read the small print.
- When you receive your council tax bill for the forthcoming financial year, if it does not include a little booklet (usually A5) the bill is not valid.
- For any bill to be valid, it needs to be considered as ’served’. Returned mail is not considered ’served’.
- Like it or not, council tax is actually due in full on 01 April every year, as per the Local Government Finance Act 1992. Councils offer a monthly installment scheme as advised by central goverment.
- Once you start paying for any financial year, you’ve already accepted the services being offered, so if you dont want to pay, dont pay at all. Look up ‘deemed contracts’ – similar thing.
- If you get summoned to court, the summons is only considered served if it not returned to the council. If the summons is returned to the council, it is invlalid, and no court hearing will go ahead. Very simple.
- No court hearing = no enforcement, AT ALL.
- once a court hearing goes ahead, the council are obliged to collect the money by any means: bailiff, attachment of earnings, charging order – i can expand on these at length if you want me to.
I dont agree with any of the above, but i do know a lot about it, so i invite you to use my knowledge as a resource. If its council tax related, i’ve done it. If its bailiff questions, I probbly know the answer. If you need to know about how the council trace you, I know this too. I know what will work, and what wont and am happy to share my knowledge with you.

I like this….very nice to see!!
But I have a question pertaining to No.6 on the list;
In commerce (which is what it’s all about in the end…) if you ignore, refuse for cause, or decline to accept, then automatically a default judgment is created against you. As in, ‘he who dishonours – loses in law’.
What’s to stop the court proceeding against you / as if you were there, if you decline to accept for cause, a liability that is presented to the legal-fiction?
I just had a summons this morning from the courts over a stupid New Years eve thing, that already is embroiling Lancashire Constabulary and four officers into litigation and an expensive commercial lien.
I did think about just returning the court summons and keeping it all clean with just the Police being involved – but like I said, isn’t that dishonouring my position as ‘Authorised Agent in Commerce’ for my legal fiction? And wouldn’t it automatically result in the civil charge escalating to ‘criminal’ ?

Ive recently been taken to court for non payment of £63 which has now become £159. I attended the court, was met by their solicitor who offered to forget the costs and let me pay 3.60 p.w. out of my income support. I told him that I had not made a 30 mile journey at my own expense to agree with them that I owed it,he told me to go back, speak to Braintree council and phone him(number supplied by him) to let him know the outcome. They then proceeded to go straight into court to seek the order,which was obviously granted. 2008 and 2009 they sent me full years c.tax rebates to an address that I’ve never claimed to live at and very definitely had never claimed for a council tax rebate at any time

First of all, please accept my sincere apologies for not responding sooner. Life in regressive taxation does not always allow the freedom required to visit this type of site. On the first point, i’m very sory, i don’t know. I have an opinion, but am reluctant to give it, as i’m no legal advisor.

Man, I think I’d rather starve than work for those thieving, hypocritical bureaucrats. I’m pretty new to this site, but Im glad I found it. Some real thought provoking stuff, and am loving how passionate the creators/contributors are on the subject.

Hi all, if there’s anyone looking form Medway i found out that Medway council had A County Court Judgement that was registered against them on 19/11/2009.
also they use whyte and co and rundle and co as there bailiff companies but someone informed me that whyte and co bulk buy council tax debts so they are not acting as bailiffs just as glorified debt collectors.
if your summoned by Medway council your invited to Medway court which is the court house along the brook. the funny thing about this is when i brought the report on Medway courts it just comes up with the ministry of justice with some listed sister companies none of which are Medway court, which leads me to believe it doesn’t actually exist on paper but will research more and keep you posted.

Hi, i posted the same information apart from the bit about whyte and co buying the debts on the lawful rebellion site and a member replied with this
“To Mescalito, I found out purely by chance when a friend wound up with a threatening & somewhat damning letter addressed to former occupants. I made the call to their offices (they’ve got loads in & around the Kent & S.London area)I basically got one of their staff talking…She let slip that they bulk buy debts, & that ineffect this was a glorified fishing trip on their part to see who would bite…They will ammend records.”

also found out yesterday from my neighbour that when Medway council send you a summons it comes in an unmarked envelope with no return address.

Hi I am glad to have found this site! I am currently battling Medway Council at the moment with regard to Council Tax. I am trying to get them to back date a claim which I believe I am entitled to but they have refused on the grounds that it is passed the backdating period, even though I have full evidence I should recieve it. I want it back dated from last year, my partner was on ESA at the time (he is now self employed) and he had an appeal against ESA which he won, but only got this confirmation in late May 10 this year, hence why I had to wait. This saga is a bit long and last week I recieved a Summons for non payment. Is there anyine who can help me who I can call?! My email address is zarabullen@hotmail.com It makes me so mad that I pay all my bills and work hard and the one time I need a bit of help they don’t want to help!!!!! I went to the Council Tax office in Chatham and the woman told me that I could write a letter, but I would be most likley wasting my time. Arghhh!
